ICC DBE Policy Statement and Objectives

The Maryland Department of Transportation (MDOT), the Maryland Highway Administration (SHA), and the Maryland Transportation Authority (the Authority) have established a Disadvantaged Business Enterprise (DBE) Program for the Intercounty Connector (ICC) Project. MDOT and SHA receive federal financial assistance from the United States Department of Transportation (DOT) and, as a condition of receiving this assistance, they have signed an assurance regarding compliance with 49 CFR 26 for all matters relating to the ICC project.

MDOT, the Authority, and SHA are committed to assuring that DBEs, as defined in 49 CFR 26, have an equal access and opportunity to receive and participate in US DOT-assisted contracts. The ICC DBE program is designed to be inclusive and to assure to the fullest extent possible maximum participation of DBEs in all ICC projects, in accordance with the stated DBE goals found in each of the 5 Mainline Design-Build Contracts, and in the Environmental Mitigation and Stewardship Contracts.

The objectives of the ICC DBE Program are:

  • To ensure non-discrimination in the award and administration of US DOT-assisted contracts
  • To create a level playing field within which DBEs can compete fairly
  • To ensure a program that is narrowly tailored in accordance with the applicable law
  • To ensure firms meeting 49 CFR Part 26 eligibility standards are permitted to participate as DBEs
  • To assist in removing barriers to the participation of DBEs on US DOT-assisted contracts
  • To assist in the development of firms so they can compete successfully in the marketplace outside of the DBE Program
  • To provide appropriate flexibility to recipients of US DOT assistance in establishing and providing opportunities for DBEs.

Marvin Eason has been designated as the ICC Civil Rights Manager. Mr. Eason is responsible for implementing all aspects of the ICC Civil Rights and DBE Program. Implementation of the ICC DBE Program is afforded the same priority as other SHA projects and programs. Compliance with all other legal obligations incurred by the MDOT and the SHA in their federal assistance agreements with the US DOT is required.
